Question: Is it always beneficial to have a home based worker be an independent contractor?

I am writing a tax memorandum for a tax class. It is based on a woman who has a home based business. She has one friend who helps her out and pays her roughly $5,000 per year for her help. She pays in cash/personal check.

From my findings, I believe that it is in fact most beneficial to continue paying cash (Her friend does pay all taxes) so that she does not have to incur the federal/state taxes.

Other notes: Her friend does control her own hours, and is not held to any certain standards.

Am I correct in my thoughts, or would there be a benefit to treating her as an employee which would result in business checks, etc.

Answer: I'm not sure what Biz Teacher is getting at. Yes, it is legal and far more beneficial to pay her by check (cash). As long as she does not qualify as a regular employee (which you clearly state) based on IRS regs. Your friend will of course have to give her a 1099-MISC and then can deduct the amount paid out on her schedule C.
